1. Who we are
These Terms & Conditions ("Terms") govern your use of the CyberActive AI platform (the "Service") provided by Cyberactive ("Cyberactive", "we", "us", "our"), trading as CyberActive AI. By creating an account or using the Service you enter into a binding agreement with Cyberactive.
2. Acceptance
By accessing or continuing to use the Service you confirm that you accept these Terms and our Privacy Notice. If you do not agree, you must stop using the Service. You confirm that you are of legal age in your country of residence and, if using the Service on behalf of an organisation, that you have authority to bind it.
3. The Service
CyberActive AI is an AI-powered career operating system for cybersecurity professionals. It provides career intelligence, interview readiness scoring, role-targeted learning content, and related tooling. Specific features available to you depend on the plan you have purchased.
4. Accounts & accuracy
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when registering and keep it up to date.
5. Acceptable use
You must not misuse the Service. In particular, you must not:
- use the Service in violation of any applicable law or regulation;
- engage in fraud, spam, harassment, or impersonation;
- infringe the intellectual property or privacy rights of any third party;
- introduce malware, probe, scan, or test the vulnerability of the Service, or otherwise interfere with its security or integrity;
- scrape, harvest, reverse engineer, decompile, or extract data from the Service except as expressly permitted;
- resell, sublicense, or redistribute the Service or any output without our written consent;
- use the Service to assist any candidate covertly during a live job interview or other assessment.
6. AI features & outputs
Parts of the Service use generative AI models. You agree to use these features responsibly and not to generate content that is unlawful, defamatory, hateful, sexually explicit involving minors, designed to deceive (including deepfakes impersonating real people), or intended to facilitate cyberattacks, malware, or other criminal activity. You must not attempt to jailbreak, bypass, or manipulate the safety mechanisms of the AI features.
You are responsible for the prompts you submit, for ensuring you have all rights to any content you input, and for verifying the accuracy and appropriateness of any output before relying on or acting on it. AI outputs may be inaccurate, incomplete, or out of date, and must not be relied upon as professional advice (including legal, financial, medical, or career-defining decisions) without independent human review.
We may moderate, filter, or refuse to generate outputs, and may suspend or terminate accounts that repeatedly violate these rules. If you believe AI-generated content infringes your rights, contact us and we will review and, where appropriate, remove it; repeat infringers will have their access terminated.
7. Intellectual property
All rights, title, and interest in and to the Service — including the underlying software, models, content, branding, and documentation — remain the property of Cyberactive and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your personal or internal business use within the plan you have purchased.
You retain ownership of the content you submit to the Service ("User Content") and grant us a worldwide, royalty-free licence to host, process, and display it solely to operate and improve the Service for you.
8. Payments, subscriptions & refunds
Paid plans are billed in advance on a recurring basis (monthly or yearly, depending on the plan you choose) and renew automatically until cancelled. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period.
Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payments, billing, applicable taxes, invoicing, and refunds are handled by Paddle in accordance with the Paddle Checkout Buyer Terms. Our refund terms are set out in our Refund Policy.
9. Suspension & termination
We may suspend or terminate your access to the Service immediately if you materially breach these Terms, fail to pay applicable fees, present a security or fraud risk, or repeatedly violate our acceptable-use rules. You may stop using the Service at any time by cancelling your subscription and closing your account. On termination you may export your data for a reasonable period before it is deleted in line with our Privacy Notice.
10. Service level & warranties
We work hard to keep the Service available, but we do not guarantee that it will be uninterrupted, error-free, or that AI outputs will meet your specific requirements. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
11. Liability
To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the Service in any 12-month period is limited to the fees you paid to Paddle for the Service in that period. We are not liable for any indirect, consequential, special, or incidental damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
12. Indemnity
You agree to indemnify and hold Cyberactive harmless from any claims, damages, or expenses arising from your User Content, your unlawful or unauthorised use of the Service, or your breach of these Terms.
13. Changes
We may update these Terms from time to time. If we make material changes, we will notify you by email or via the Service. Continued use after the changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, unless a mandatory consumer protection law in your country provides otherwise.
